FN 6. After the fire, Austin sent defendant a letter dated May 19, 1980, advising defendant that a claim had been made against him to recover the contents of the storage locker. On July 29, 1980, Austin sent defendant a further letter advising him that it was necessary to contact the insurance company to determine the items which were lost in the fire and requesting that defendant forward a list of the items claimed in the letter. Austin received defendant's reply on August 4, 1980, which consisted of a list of items claimed but not listed on the letterhead of a local attorney. Austin received a further letter from defendant on November 6, 1980, to the effect that the property had been placed in storage with an attorney, and that the matter of the claim would be taken up with the attorney in the near future. Austin received no further information respecting the matter from defendant until he was contacted by the local law enforcement authorities in April 1981.
